我在美国联邦法院查到三起姜波的案件,案件编号分别为:(1)4:13-mj-00047-1; (2)4:13-cr-00034-RBS-DEM-1; (3)4:13-mj-00076-DEM-1。

其中(1),(2)两个案件指控姜波对联邦调查局与美国土安全部撒谎。但这两个案子都未经审判被撤案,这说明奥巴马政府对于姜波的指控没有有效证据。

第三个案子的指控是:“姜波用NASA提供的笔记本电脑下载、观看、存储受版权保护的电影、电视节目以及性表演资料”。参见:jiangbo-information.pdf

姜波对第三个指控签了认罪协议,这份协议的非常值得一看。参见: jiangbo-plea-agreement.pdf 。感觉是,美国政府枪顶在姜波的太阳穴,让他别控诉美国。

听说,他最高面临5年的牢狱OR25万美元的罚款,又说被遣返回中国,我不太明白美国的法律制度,请问,如果坐牢了,还怎么遣返回中国?是先坐牢再遣返?还是交了罚款再遣返?执行哪个呀??谢谢指教.

估计是姜波的律师要他认罪轻罪。其实这种非法下载色情资料的指控能关押他多久?他可以硬挺着,看看美国政府拿他怎么办。但是,翟田田那时候还有父亲告诫“士可杀,不可辱”,姜波的情况外面人是不知道的,狱卒很可能通过律师控制他的接触人和信息的来源,再加上这些学术“精英”都很自以为是,真碰到帮忙的建议,也不一定听得进去。整体上讲,美国华人还没有足够经验应付这类紧急情况。

教训:千万不要用公司网络下载于工作无关的东西,更不要沾上色情网站和图片。被FBI缠上,除非您完美的无邂可击,否则按照人无完人的定律,他们总能找到办法整你。
