一个一百年前失败了的华人人权抗争故事，读《水滴石穿》有感
<div><p><img alt=" zzwave.com" data-ratio="0.10555555555555556" data-type="gif" data-w="720" src="/data/attachment/ud/2017/0619/0a01f3c9.gif" style="" width="720" /><p><br /><p><img alt=" zzwave.com" data-ratio="1.5450643776824033" data-s="300,640" data-type="jpeg" data-w="466" src="/data/attachment/ud/2017/0619/8f6e6ffa.jpeg" style="" width="466" /><p dir="ltr"><br /><p dir="ltr">《水滴石穿》（Water Tossing Boulders， by Adrienne Berard) 讲述了一个上个世纪密西西比州的中国人Lum(林）的家庭故事，一个失败了的人权抗争故事。<p dir="ltr"><br /><p dir="ltr">上个世纪二十年代，Martha Lum和她姐姐Berda Lum因为肤色原因一起被学校开除。<span style="color: rgb(255, 0, 0);">根据密西西比州法规定，Rosedale的高中是个白人高中，而中国人是有色人种，不能在白人学校读书。</span><p dir="ltr"><br /><p dir="ltr">Martha的父母决定为Martha姐妹的入学权力跟学校抗争。他们找到了前州长Brewer做为律师跟学校打官司。他们先是在县法院上赢了官司，但很快学校上诉到州最高法院，在那里，Lum输掉了官司。Martha姐妹正式失学。<p dir="ltr"><br /><p dir="ltr">Lum和Brewer 决定继续上诉到联邦最高法院。可惜在关键时刻由于Brewer忙于其他案件，找了个胆小的生手代理，而且在联邦法院接受案件后，他们没有时间准备去Washington DC争议。整个案件在无当事人参与的状态下，联邦法院作出判决，维持州法院原判，并且声明州最高法院对教育中的种族隔离政策有最终说明权。由于这个判决，很多州也实施了教育隔离政策。<p dir="ltr"><br /><p dir="ltr"><span style="color: rgb(255, 0, 0);">这种教育隔离政策使得几代华人的教育受到了影响。</span>很多南方的华人孩子只能接受私人教育或者就放弃了受教育教育的机会。最后Lum全家搬离了密西西比州，同时很多中国人也搬到其他没有教育隔离政策的州。<p dir="ltr"><br /><p dir="ltr">这个Lum vs. Rice案例对教育中的种族隔离政策有着深远影响。一方面，Brewer等人意识到教育隔离侵犯了第十四修正法案的公民权，是和当时解放黑人的做法背道而驰。但另一方面，那个年代是种族隔离政策盛行的Jim Crow法案时代，是排华法案时代，是KKK党最强盛的时代。<span style="color: rgb(255, 0, 0);">美国白人认为白人在教育上有特权，需要保持血统纯净。所有非白人种族不能侵犯他们的权利。</span>在密西西比州，州法公开声明有色人种不能在白人高中读书。<p dir="ltr"><br /><p dir="ltr">即使为Lum辩护的律师也没有意识到这种不平等的问题。他们只强调Martha是个美国公民，她不是黑人，但没有从根本上思考这种教育隔离的不平等政策，结果造成辩护的论证不充分，有些论点甚至自相矛盾。在当时的大环境下，Lum的案件基本不可能赢。<p dir="ltr"><br /><p dir="ltr"><span style="color: rgb(255, 0, 0);">直到1954年的 Brown vs. Board of Education案件</span>, 黑人社团统一行动, 动员了几百位专家进行论证，在联邦法院赢得了官司，<span style="color: rgb(255, 0, 0);">在司法上结束了教育隔离政策。</span>对传统上非常重视教育的华人而言，这更是一个重要的法律判决。很多南方华人从那时起可以接触到合格的教育，进一步提高了华人子女的受教育程度。<p dir="ltr"><br /><p><img alt=" zzwave.com" data-ratio="0.5230769230769231" data-s="300,640" data-type="png" data-w="650" src="/data/attachment/ud/2017/0619/8426c9c2.png" style="" width="650" /><p dir="ltr"><span style="font-size: 14px;">林家合影 <span style="font-size: 11px;"><em>Photo courtesy of the Lum family.</em></span></span><p dir="ltr"><br /><p dir="ltr">作者在这本书里非常详细地介绍了历史背景，客观地描述了当时的种族和社会意识的冲突。但美中不足的是作者没有对当事人及当时华人的心态进行深入描写和讨论，我们无法知道当地华人对这件事的看法和反思。当然瑕不掩瑜，作者把这个事件客观地记录下来，让历史记住这个事件，这是最重要的。<p dir="ltr"><br /><p dir="ltr">今天我们华人更需要读一读这类书，需要了解白人至上主义的危害，海外华人需要团结起来，不能让Martha Lum的悲剧重演。<p dir="ltr"><br /><p><img alt=" zzwave.com" data-ratio="0.6365795724465558" data-s="300,640" data-type="jpeg" data-w="421" src="/data/attachment/ud/2017/0619/2f43ab02.jpeg" style="" width="421" /><p dir="ltr"><br /><p style="text-align: center;"><img alt=" zzwave.com" data-ratio="0.03125" data-w="640" src="/data/attachment/ud/2017/0619/c0e92b6f." style="" title="分割线" width="640" /><p><br /><p>作者：Xinhua Yu<p><span style="font-size: 13px;
